On April 24, 2022, Citizens Union filed an amicus brief in the matter of Harkenrider v. Hochul, the case challenging the newly drawn congressional and legislative district maps in New York, which is now before the New York Court of Appeals. Citizens Union joined the Campaign Legal Center in filing this brief.
The brief, which is in support of neither party in the case, urges the Court of Appeals to give great weight to the anti-gerrymandering provision in the State Constitution when considering the appeal challenging the legality of the maps passed by the legislature. Partisan gerrymandering is anti-democratic, increases polarization and reduces accountability. Citizens Union fought hard to add the anti-gerrymandering provision to the State Constitution in 2014. The Court of Appeals should invalidate any lines it finds that are in violation of this provision.
